Welcome to the online clinical practice of Dr. Pretty Duggar Gupta. These Terms and Conditions (“Terms”) govern your use of our website, appointment booking system, and telehealth/in-person psychiatric services (collectively, the “Services”).

By accessing the website or booking an appointment, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

This platform and online consultation services are STRICTLY NOT FOR MEDICAL OR PSYCHIATRIC EMERGENCIES. If you are experiencing thoughts of self-harm, suicide, severe clinical deterioration, or any other medical emergency, immediately visit the nearest hospital emergency department or contact a local crisis helpline (e.g., Vandrevala Foundation, iCall, Aasra). Dr. Pretty Duggar Gupta cannot provide emergency medical intervention via teleconsultation.

Nature of Services & Medical Disclaimer

1.1

Scope of Telepsychiatry: Tele-consultations are subject to the Telemedicine Practice Guidelines, 2020 (India). Dr. Pretty Duggar Gupta reserves the right to determine whether a teleconsultation is appropriate for your specific condition. If in-person care is deemed necessary, the online session may be terminated or redirected.

1.2

Doctor-Patient Relationship: A formal doctor-patient relationship is established only after you have completed the booking process, agreed to these Terms, and the consultation has officially commenced.

User Obligations & Consent

2.1

Accurate Information: You agree to provide true, accurate, and complete information regarding your identity, medical history, and current medications. Deliberate concealment of medical facts relieves the clinic and Dr. Pretty Duggar Gupta of any liability arising from adverse outcomes.

2.2

Age Requirement: You must be 18 years or older to book an appointment. For minors, consultations must be booked by a parent or legal guardian who must be present during the entire consultation.

2.3

Consent for Treatment: By booking a session, you provide explicit consent to undergo psychiatric evaluation and treatment, which may include the prescribing of medications as per the doctor’s clinical judgment.

Prescription Policy

3.1

Adherence to NMC Guidelines: All prescriptions generated through teleconsultations strictly adhere to the National Medical Commission (NMC) Telemedicine Practice Guidelines.

3.2

Restricted Medications: Certain medications — such as those under Schedule X or highly habit-forming psychiatric drugs — cannot and will not be prescribed during a first-time online consultation. An in-person consultation is mandatory for such prescriptions.

3.3

No Guarantee of Prescription: Booking an appointment does not guarantee that a medication will be prescribed. Prescriptions are solely at the professional discretion of Dr. Pretty Duggar Gupta.

Booking, Cancellation & Refund Policy

4.1

Payment: Full payment is required at the time of booking to secure your appointment slot.

4.2

Cancellations & Rescheduling: You may cancel or reschedule your appointment up to 24 hours before the scheduled time without penalty. Cancellations made less than 24 hours before the appointment will not be eligible for a refund.

4.3

No-Show Policy: If you fail to join the consultation within 10 minutes of the scheduled start time, it will be considered a “No-Show.” No-shows are strictly non-refundable.

4.4

Provider Cancellations: In the rare event that Dr. Pretty Duggar Gupta must cancel a session due to an unforeseen medical emergency or unavailability, you will be offered a priority rescheduled slot or a full refund.

Code of Conduct & Zero Tolerance Policy

5.1

Respectful Behaviour: We maintain a strict zero-tolerance policy against abusive, threatening, or inappropriate behaviour — including foul language, sexual harassment, or violence directed at the doctor or clinic staff.

5.2

Termination of Care: Violation of this code of conduct will result in immediate termination of the consultation without a refund and permanent barring from the practice. Legal action may be initiated if necessary.

5.3

No Recording: Patients are strictly prohibited from taking audio or video recordings of the consultation, or capturing screenshots. Unauthorised recording violates patient confidentiality and the doctor’s privacy, and will result in immediate termination of services.

Limitation of Liability & Indemnity

6.1

Limitation of Liability: To the maximum extent permitted by law, Dr. Pretty Duggar Gupta and the clinic shall not be liable for any direct, indirect, incidental, or consequential damages resulting from: (a) your use or inability to use the platform; (b) technical failures, network issues, or platform outages during teleconsultations; or (c) failure to follow the medical advice provided.

6.2

Indemnification: You agree to indemnify and hold harmless Dr. Pretty Duggar Gupta from any claims, losses, damages, or legal expenses arising from your failure to provide accurate medical information, your violation of these Terms, or your misuse of the prescribed treatment.

Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from or in connection with these services shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka.

By proceeding to book an appointment or use any of our services, you confirm that you have read, understood, and unconditionally agree to be bound by these Terms and Conditions in their entirety.
